Agreement to These Terms
These Terms of Service govern your access to and use of Pixelmixnt, including the website, account dashboard, art upload tools, NFT minting features, marketplace listings, bidding tools, wallet activity features, communications, and related services. By creating an account, browsing the marketplace, uploading content, placing a bid, or using any platform feature, you agree to these Terms.
If you do not agree to these Terms, do not use Pixelmixnt. These Terms apply together with the Privacy Policy and any additional notices, rules, or feature-specific terms shown in the platform.
Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, and able to enter into a binding agreement. You may not use Pixelmixnt if you are barred from using the service under applicable laws, sanctions rules, marketplace restrictions, or these Terms.
You are responsible for making sure your use of NFTs, crypto assets, wallets, and marketplace services is lawful in your location. Pixelmixnt is not responsible for determining whether your transactions are permitted under laws that apply to you.
Accounts and Security
You must provide accurate account information and keep it updated. You are responsible for safeguarding your login credentials, account sessions, wallet details, and devices. Any activity under your account is your responsibility unless you promptly notify Pixelmixnt of unauthorized access and we determine otherwise.
Pixelmixnt may limit, suspend, or terminate accounts that appear compromised, abusive, fraudulent, unlawful, inactive, or in violation of these Terms. We may also require additional account checks before enabling or continuing access to certain features.
Marketplace Role
Pixelmixnt provides tools for creators, collectors, and users to upload digital art, mint NFTs, organize collections, list assets, place bids, accept bids, and maintain marketplace records. Unless expressly stated otherwise, Pixelmixnt does not guarantee the value, authenticity, legality, quality, future utility, resale potential, or availability of any NFT, artwork, collection, creator, or bid.
NFTs and crypto assets can be volatile, experimental, and subject to technology, market, network, regulatory, and security risks. You should evaluate each listing, creator, collection, wallet address, and transaction before acting.
Artwork, NFTs, and Intellectual Property
You may upload, mint, list, or sell only content that you own or have the legal right to use. By submitting artwork, files, descriptions, collection names, profile content, or other materials, you represent that your content does not infringe intellectual property rights, privacy rights, publicity rights, contractual rights, or any other rights of another person or entity.
When you upload content, you grant Pixelmixnt a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, resize, format, promote, and otherwise use that content as needed to operate, market, and improve the marketplace. This license allows us to show your artwork, NFTs, listings, collections, and related metadata across the platform.
Buying or receiving an NFT does not automatically transfer copyright, trademark rights, commercial rights, or other intellectual property rights in the underlying artwork unless the creator or seller expressly grants those rights in writing. NFT ownership generally represents ownership or control of the token or platform record, not unrestricted ownership of the underlying creative work.
Creator Responsibilities
Creators are responsible for the accuracy of titles, descriptions, prices, collection details, metadata, file uploads, ownership claims, and any promises made about artwork or NFTs. Creators must not upload stolen work, misleading content, malicious files, spam, counterfeit assets, or content that violates law or platform rules.
Pixelmixnt may remove, hide, restrict, or delist content that appears infringing, fraudulent, unlawful, unsafe, misleading, or otherwise harmful to the marketplace. Removal from the platform interface may not remove any information that has already become public or has been recorded on a blockchain or third-party system.
Listings, Prices, and Bids
Prices, bids, balances, and fees may be displayed in ETH and may include estimated USD conversions for convenience. USD estimates are informational only, may change quickly, and may differ from final settlement values, exchange rates, network costs, or third-party pricing.
A bid represents an offer to buy at the submitted amount. Sellers may accept, reject, or ignore bids unless a feature states otherwise. When a valid bid is accepted, Pixelmixnt records the sale and updates platform ownership records according to the transaction flow available at that time.
You are responsible for reviewing the NFT, artwork, price, bid amount, wallet balance, fees, and transaction details before submitting or accepting any marketplace action. Completed marketplace actions may not be reversible.
Wallet Funding, Balances, and Payouts
Pixelmixnt may provide wallet balance features that allow users to fund platform activity, pay minting fees, place bids, receive sale proceeds, and request payouts. Wallet balances and payout activity are subject to platform validation, risk controls, network availability, applicable limits, and applicable law.
You are responsible for entering accurate transaction hashes, wallet addresses, network selections, payout details, and other wallet-related information. Sending assets to the wrong address or selecting the wrong network may result in permanent loss, and Pixelmixnt may not be able to recover funds or reverse blockchain transactions.
Funding, bidding, sale proceeds, fees, and payout values may be affected by market volatility, network congestion, transaction delays, security checks, third-party infrastructure, gas fees, and other conditions outside Pixelmixnt's control.
Fees
Pixelmixnt may charge minting fees, marketplace fees, service fees, or other fees shown in the platform. Fees may be updated from time to time. You are responsible for reviewing applicable fees before using a paid feature or completing a transaction.
Prohibited Conduct
You agree not to use Pixelmixnt to violate laws, infringe rights, upload harmful content, manipulate bids, launder money, evade sanctions, impersonate others, misrepresent ownership, harass users, distribute malware, scrape the service without permission, interfere with platform security, exploit bugs, create fraudulent accounts, or engage in activity that harms the marketplace or its users.
We may investigate suspected violations and take action, including content removal, account restriction, transaction limits, suspension, termination, or cooperation with lawful requests from authorities.
Communications
Pixelmixnt may send emails and platform messages about account creation, login activity, bids, accepted offers, wallet activity, marketplace updates, security notices, policy changes, newsletter subscriptions, and support matters. You may unsubscribe from newsletter communications, but service-related messages may still be sent when needed for your account or marketplace activity.
Third-Party Services and Networks
Pixelmixnt may interact with third-party services, wallets, blockchains, infrastructure providers, email providers, analytics tools, or links to external websites. Third-party services are governed by their own terms and policies. Pixelmixnt is not responsible for third-party outages, wallet behavior, network changes, blockchain forks, gas fees, pricing feeds, or external content.
Disclaimers
Pixelmixnt is provided on an "as is" and "as available" basis. We do not promise uninterrupted service, error-free operation, guaranteed liquidity, guaranteed pricing, guaranteed sale outcomes, or that every NFT or artwork will retain value. Marketplace content may include user-generated materials that Pixelmixnt does not independently verify.
Nothing on Pixelmixnt is financial, investment, tax, accounting, or legal advice. You should consult qualified professionals before making decisions involving digital assets, taxes, securities laws, intellectual property, or regulatory obligations.
Limitation of Liability
To the fullest extent permitted by law, Pixelmixnt and its operators, affiliates, service providers, and personnel will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including lost profits, lost data, loss of digital assets, loss of goodwill, or marketplace losses arising from your use of or inability to use the platform.
Indemnity
You agree to defend, indemnify, and hold Pixelmixnt harmless from claims, damages, losses, liabilities, costs, and expenses arising from your content, account activity, marketplace transactions, violation of these Terms, violation of law, or infringement of another person's rights.
Service Changes
Pixelmixnt may add, remove, pause, modify, or discontinue features at any time to improve the service, maintain security, respond to market or network conditions, comply with requirements, or support platform operations. We may update these Terms when the service changes or when legal, operational, or security needs require updates.
Termination
You may stop using Pixelmixnt at any time. Pixelmixnt may suspend or terminate access if you violate these Terms, create risk for the platform, infringe rights, engage in prohibited conduct, or if continued access would create legal, security, or operational concerns. Certain records may be retained as described in the Privacy Policy.
Governing Terms
If any part of these Terms is found unenforceable, the remaining terms will continue in effect. Failure to enforce a provision does not waive our right to enforce it later. These Terms, together with the Privacy Policy and any feature-specific notices, form the agreement between you and Pixelmixnt for use of the platform.
